3 Reasons Divorces Spike in August

August sees a spike in divorce filings. For many years our expert Family Law Attorney Bob Leonard has seen an uptick in divorces in our office in the month of August. According to our research, partners filing for a divorce in the month of August is a common trend across the country.


There have been many studies through the years investigating the root cause of an uprise in divorces during August. There are three commonalities we found from talking to our clients and researching previous studies.


1: Partners schedule their divorce around the kids.

- Some partners wait until their children leave for college in August. They find themselves with an empty nest when their children go to college and file for divorce in August. This leaves them with the time to really look at their marriage and their partner and, in some cases, decide it isn’t working anymore.

- On the opposite end of the spectrum are  couples who still have children living at home.  With school starting, they use this time to file for divorce hoping it will give their children time to process the change while there are activities to keep them busy.


2: Couples schedule their divorce around summer vacations.

- Many couples start planning big family vacations far in advance. Holidays can be culturally sacred times for families. The results of a study by University of Washington suggest that unhappily married couples arrange an August divorce filing after summer vacations to avoid disappointing children or extended family.


3: Summer is the most common time partners meet someone new.

-  According to a study by National Library of medicine, infidelity is the most common cause for divorce. Summer is when people take the most time off of work and take the most vacations. Vacations, although meant to be enjoyable, can sometimes be even more stressful for some people. This environment has been shown to cause a rise in adultery resulting in filing for divorce when summer is ending.
