It is not at all uncommon for clients to come to our office for a divorce consultation with a compelling story of the injustices that have been perpetrated on them.  Their child was “kidnapped,” they were beaten, the other spouse is a drug user.

 

If that person retains us they are asked to fill out an extensive questionnaire and give us “all” of the facts of the case.

 

Imagine when we get to the courthouse.  This is where we learn that there is another side of the story.  Our client tests positive for drugs.  A policeman is subpoenaed and he testifies that he saw our client assault the other party. Our client had hidden the children from the spouse, family and friends. A good divorce lawyer can think on their feet. But, there is a limit to what we can do when we are blindsided.

 

Every party has helpful facts about their case and every party has harmful facts.  It is the lawyer’s job to sort through these and determine how to put on the most successful case possible.

 

I have had cases where my client tells me that she/he has recently tested positive for marijuana. Not a huge problem unless it is right before we walk into the courtroom.  By that time it is simply too late to take steps to present evidence to off set these facts.  Had I known earlier, we could have also drug tested and present clean testing or enroll in drug counseling to show it isn’t an issue. I wouldn’t of asked for particular hearing date and time if I knew all the facts, or I simply would of been better able to negotiate a settlement with the other party because I was aware of the facts.

 

The fact is, If my clients tells me she/he has tested positive for marijuana or if they are tested in the next few days they will test positive. I can do my job so much better.
