GRANDPARENT'S RIGHTS

Years ago, it was not too difficult for grandparents to get involved in their children's lives by getting involved in court cases concerning their grandchildren. Then the United States Supreme Court held that the state could not interfere in a "fit" parent's raising of that parent's child. If the parent was "fit" then the parent had the right to make decisions about his or her child without interference from a grandparent.

Now, for a grandparent to succeed in court against a parent, the grandparent must prove that the parent is not fit by proving that the child's "present circumstances would significantly impair the child's physical health or emotional development." Unfortunately, that is all too common today.
